ALTERNATIVE DISPUTE RESOLUTION

Tyler & Bursch, LLP, is committed to exploring all of the potential options that might be of help to our clients. Alternative Dispute Resolution (“ADR”) is one of the newest methods of settling disputes outside of the litigation process that may offer you certain benefits. ADR has gained broad acceptance as a solution that can be a more cost and time effective alternative to the traditional litigation process. ADR may be a particularly attractive option when the parties are interested in keeping the details of the conflict private, maintaining a relationship with the opposing party, or having more control over the timetable and costs for settling the dispute. Additionally, you may also find yourself involved in a dispute where ADR is mandated by contract or a court.

Many processes fall under the category of ADR. They can include mediation, both binding and non-binding arbitration, or a combination of mediation and arbitration. While there are large national organizations that offer their services to provide the forum to facilitate ADR, Tyler also seeks to use small and more specialized services where appropriate for our clients. For example, when disputes arise between individuals or organizations with religious affiliations, it may be appropriate to seek a forum that understands and respects those interests as well. This can be especially true in the case of religious nonprofit organizations. Tyler will use its knowledge of the ADR process to advise you regarding the viability of your potential options.

Tyler’s attorneys are able to take their knowledge and expertise in representing clients in litigation, and transfer that to the ADR process. We will take our same focus and attention to the details of your needs that we use in litigation, and apply that to our advocacy on your behalf before a mediator or arbitrator. Our attorneys are able to resolve all manner of disputes through the ADR process, including business disputes, real estate matters, construction matters, and employment issues.
